The website www.festanca.org hereinafter designated as “site” is property of GENERATIONS IN TRANSITION – ASSOCIAÇÃO JUVENIL, based at Rua dos Bombeiros 13, 4620-654 Lousada (Portugal), with tax ID number 515439770, registered at the Commercial Registration Office with the same number, as a non-profit association, hereinafter designated as “GIT” or “EVENT PROMOTER” or “PROMOTER”.

The use of this site grants whoever does it, the condition of user, and reflects the full acceptance with no reservation by the user of the terms and conditions of the site and the event.

The use made by the user of any information, contents, products or services available on or through the website, is subject to this Terms and Conditions and to the Privacy Note.

“GIT” does everything in its power to ensure the availability of the website is continuous and that all communications are free of errors. Nevertheless, due to internet’s nature, they cannot guarantee this. Moreover, the access to the website can be interrupted occasionally for repair, maintenance or inclusion of new services. “GIT” will do its best to make these interruptions rare and of short duration.

“GIT” may, at any time, modify the terms and conditions of this website, which, once published, are considered accepted by the user on the next visit to the website.

LICENSE TO USE THE WEBSITE

“GIT” grants you a free and limited license to access and use its website, except to modify or download (except if specifically authorised) of all or part of the website, without “GIT”´s prior written consent.

This license does not include any permission to sell or make a commercial use of this website, or its contents; any modified use of the website or its contents, which are not public domain; any download or copy of information for the benefit of third parties; any use of tools such as data mining, robots, or any other for the extraction and data compilation.

USERS CONDUCT

You should not use the website in any way that can cause, now or in the future, problems on its normal function or on its availability. The users, and not “GIT”, are responsible for all electronic communications and contents sent from their computers to this website, and can only use them for legitimate purposes.

This website cannot be used for fraudulent purposes, or any purpose connected with illegal activities; to send, use or reuse any material that is illegal, offensive, abusive, defamatory, obscene or threatening; or that disrespects copyright, privacy or any other right; or sending materials which contains virus, politic propaganda, or spam.

The users of the website declare to know and accept the terms and conditions of the website and ensure to respect it and take responsibility for all actions or omissions that contradict them.

RESPONSABILITY

Although “GIT” makes all efforts to ensure there are no errors and that all information is updated, cannot assume the responsibility for the exactitude of all contents and damage that may arise from them.

“GIT” reserves the right to suspend or modify the contents or the way they are presented, change its designation or even close the website, whenever considered necessary according to its strategy and technical needs, without any prior warning and for the time considered necessary, without any responsibility to indemnify.

Copyright is recognised regardless of registration, deposit or any other formality.

All content referred herein, including text, graphs, logos, buttons, images, audio clips, video clips and software are property of “GIT” or third parties duly identified, and is protected by the Portuguese Code of Copyright. Thus, the reproduction or representation of all or part of any of these distinctive signs is strictly prohibited and must be subject to prior written authorization from the trademark owner. The compilation of all data and its layout are property of “GIT”.

TERMS AND CONDITIONS OF TICKET OFFER FOR THE FESTIVAL “FESTANÇA”

1 – Age rating: All ages admitted.

2 – Children under 12 years old may only enter the Festival duly accompanied by the holder of parental responsibilities (parents) or by a duly identified adult that takes responsibility for them. If doubts about the age of the minor are raised, the people in charge of inspection may request proof of age identification, under penalty of being denied entry into the venue. People under 12 have free entrance into the festival’s venue as long as they fill the registration form.

3 – The ticket is only valid for the place and date indicated in the ticket or in the website festanca.org, prevailing this last one in case of conflict.

4 – There are two types of tickets, the all-days ticket, and the daily ticket, as well as 3 distinct phases for the ticket sales (beyond the pre-sale season for reserving the tickets):

PHASE I – PRE-RESERVATION OF THE TICKETS FOR FESTANÇA 2023

This is the phase in which you can book your tickets in advance, and you will only pay for them when PHASE I of ticket sales starts. This gets you one of the Phase I tickets at a special price, limited to 400 tickets.

PHASE II – ONLINE TICKET SALES FOR FESTANÇA 2023

This is the lowest priced ticket available and this will be the first period of anticipated ticket sales. If payment is made to one of our ambassadors, or if it is made by mbway (only possible for Portugal users), you are entitled to a full refund. If payment is made by another means, the ticket does not entitle to a refund, but if you cannot attend, you can choose not to pay at the festival’s welcome centre the half of the ticket that you did not pay in the initial purchasing process. This phase is limited to a total sale of 800 tickets..

PHASE III – TICKET SALES AT THE FESTIVAL’S VENUE FOR FESTANÇA 2023

This is the highest priced ticket available and will be the last ticket period, sold at the festival’s welcome centre from the 26 July to 6 August 2023. There is no right to a refund.


5 – Alcoholic beverages will not be served to individuals under the age of 18 and to people who are visibly impaired.

6 – The entry of objects considered dangerous by the organisation, or others prohibited by law, substances prohibited or likely to generate acts of violence, namely explosive and pyrotechnic material, weapons or objects that may serve as weapons, tools, spray pumps, etc. is not allowed.

7 – Any person demonstrating violent, aggressive or otherwise unlawful behaviour, displaying symptoms of intoxication or having drugged drugs, or refusing to expropriate unauthorized or unapproved objects shall be refused entry into the Festival.

8 – The entry of animals is not permitted in the festival’s site, except for guiding dogs for the blind. There have been problems with lost dogs in the past, and with dog fights. Be aware that the sun, dehydration, noise and density of crowds can increase the stress and health problems of our beloved pets. Due to this, pets are not allowed at Festança. Although, there is another exception: if you really have to take your pet with you because you don’t have where to put him, in case you come with your van to the van parking, you can obviously put him there with the right conditions and not loose.

9 – Smoking is not allowed in all enclosed spaces of the Festival, in compliance with the provisions of Law 37/2007 of 14 August.

10 – Audio and video recordings and broadcasts of all or part of the event by any means, as well as the use of professional cameras, are strictly not allowed.

11 – The ticket holder recognises that his image can be captured and recorded during the event, and therefore, grants, free of charge, to the Promoter all the image rights he/she has on them.

12 – In case of cancellation of the event, rescheduling, replacement of the main artists, the admission ticket price is not refundable, and the ticket will remain valid for the next rescheduling edition, under the legal terms.

13 – There will be no refund if the performance is not performed due to force majeure, or any unpredictable events whose effects happen without the will or responsibility of the Promoter (Decree-Law no. 23/2014, of 14 February).

14 – The ticket holder acts at his own risk, expressly acknowledging that the Promoter cannot be held liable for any risks or damages, or for any other incident, whether it occurs before, during or after his permanence in Festival, except for incidents resulting from negligence or wilful misconduct by the Promoter.

15 – The resale of the tickets as well as their use for promotional or institutional purposes is not allowed, unless you have the prior express consent of the Promoter, or except you use ticketswap platform.

16 – The ticket holder will lose his rights upon leaving the venue.

17 – The ticket holders, whose actions are inconsistent with these Terms and Conditions, may see refused its entry or permanence in the Festival and the respective tickets cancelled without refund. The Promoter, using its decision-making powers, reserves the right to take other legal means.

18 – The Promoter reserves itself the right to update and introduce changes and amendments to the rules established in these Terms and Conditions, without prior communication.

19 – The holder of the ticket must periodically, to stay informed, consult them in www.festanca.org where it will always be an updated version of the Terms and Conditions.

20 – The Promoter reserves the right to change or modify the Event program.

21 – The ticket holder expressly declares that he has read, understood and accepted, fully and without reservation, these Terms and Conditions and is fully aware of the rights and obligations arising from them.

CLAIMS

The rights and remedies provided herein, and any and all claims and disputes related to it and/or the services, will be governed, interpreted and applied in all aspects solely and exclusively in accordance with the internal Laws of Portugal.

APPLICABLE LAW

This Terms and Conditions are ruled by the Portuguese Law.
